Welcome to The Graphic Geek (“Company”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your use of our services, including but not limited to web and graphic design, printing, domain registration, and managed WordPress hosting. By engaging with our services, you agree to abide by these Terms. If you do not agree, please do not use our services.


1. General Terms

  • All services provided by The Graphic Geek are subject to these Terms.
  • We reserve the right to modify these Terms at any time. Clients will be notified of significant changes.
  • Continued use of our services after changes are posted constitutes acceptance of the new Terms.

2. Hosting Services

Billing and Suspension Policy

  • Invoices for managed WordPress hosting services are due within 7 calendar days of issue.
  • Websites with invoices more than 7 days past due will be suspended and rendered inaccessible online. Access to the billing hub will remain available for payment.
  • If an invoice remains unpaid for 60 days, the website and its contents will be deleted from our servers.
  • After deletion, clients have 14 days to request restoration from available backups. After 14 days, all site data will be permanently deleted, and restoration will no longer be possible.

Refunds for Hosting Services

  • Hosting services are non-refundable once service is active.
  • Clients are encouraged to contact us with questions or concerns prior to subscribing to ensure proper plan selection.

3. Design Services

  • Graphic and web design services include one or more rounds of revisions, as specified in the project quote.
  • Final proofs must be reviewed and approved by the client before files are finalized or sent to print or live deployment.
  • The Graphic Geek is not responsible for errors or omissions found after client approval.

4. Print Services

Proofing and Accuracy

  • All print jobs include a final digital proof for client approval. The client is responsible for reviewing all content, layout, and formatting.

Refund & Reprint Policy

  • Refunds or reprints will be issued only in the event of a printing error that is clearly the fault of The Graphic Geek.
  • Mistakes or oversights resulting from the client’s failure to review and approve the proof will be non-refundable and may only be corrected at our discretion.

5. Domain Registration

  • Domain registration services are provided as a convenience through third-party registrars.
  • Renewal reminders will be sent via email. Failure to pay by the due date may result in loss of the domain.
  • We are not liable for domains lost due to non-payment or inaccurate contact information provided by the client.

6. Intellectual Property

  • Unless otherwise agreed upon in writing, all original design work created by The Graphic Geek remains the intellectual property of the Company until full payment is received.
  • Clients are granted a license to use completed work for the purposes stated in the agreement.
  • Redistribution, resale, or modification of work without permission is strictly prohibited.

7. Limitation of Liability

  • We do not guarantee uninterrupted or error-free operation of any services.
  • Our total liability for any claim related to services is limited to the amount paid by the client for those services in the previous 30 days.
  • The Graphic Geek shall not be held liable for any indirect, incidental, or consequential damages.

8. User Accounts

  • Some services may require you to create an account.
  • You are responsible for maintaining the confidentiality of your account and password.
  • You agree to provide accurate and up-to-date information.
  • We reserve the right to suspend or terminate accounts that violate our Terms.

9. Third-Party Links & Services

  • Our website may contain links to third-party sites (e.g., Stripe, Square, HubSpot CRM).
  • We are not responsible for the content, privacy policies, or security of third-party services.
  • Users should review the terms and conditions of any third-party service they use.

10. Termination

We reserve the right to terminate or suspend services for:

  • Violations of these Terms.
  • Non-payment for services.
  • Any action that harms our business, reputation, or other users.
  • Hosting or distributing content that includes sexually explicit material, illegal activity, hate speech, or other material deemed inappropriate, including but not limited to content that violates copyright or intellectual property laws.
  • Receipt of credible claims of copyright or trademark infringement, or complaints of misuse of our platform for unlawful or unethical purposes.
  • Any attempt to use our services for spam, phishing, or fraudulent behavior.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law principles.


12. Arbitration

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the services provided, both parties agree to resolve the matter through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in La Porte County, Indiana, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction. Each party shall bear its own costs associated with arbitration. This clause does not preclude either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction.

14. Force Majeure

The Graphic Geek shall not be held liable for any failure or delay in performance of services due to causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, acts of government, communication failures, utility outages, cyberattacks, or labor disputes.


15. Non-Disparagement

Clients agree not to publicly defame, disparage, or criticize The Graphic Geek or its employees. Concerns should be directed through our support or management channels. This clause is not intended to limit honest feedback provided through legitimate review platforms.


16. Service Level Description (SLD)

We strive to maintain a 99.9% uptime for our hosting services, excluding scheduled maintenance or events beyond our control. Support inquiries will be addressed within 1–2 business days, with priority given to urgent service-impacting issues.


17. Affiliate Links Disclosure

Some articles published in our “Business Talk” blog may contain affiliate links. This means we may receive a commission if you click a link and make a purchase or sign up for a service. These commissions help support our content and operations, at no additional cost to you. We only promote products or services that we have vetted and believe may add value to our readers. Use of affiliate links will never influence the editorial content or recommendations found on our site.
